Military members have certain rights when they have a
medical or mental health condition which is serious
enough that they are facing a medical evaluation board
(MEB) or a physical evaluation board (PEB).
An MEB typically takes place at the local military treatment
facility, and consists of an examination of the member
and the member's records. An MEB report is generated
and sent to the informal PEB.
The informal PEB reviews the report and the member's
records and comes to certain conclusions regarding
whether the member should be retained on active duty,
medically separated or medically retired. They also
recommend a certain percentage of disability.
Once this recommendation is received the member has a
short period of time in which to accept the IPEB
recommendation or demand a formal PEB hearing.
We advise you during the MEB/PEB process. In addition,
we represent you at the formal PEB, where members
have the right to obtain civilian counsel to represent them
in presenting evidence and testimony to demonstrate to
the board that medical separation/retirment is appropriate
and/or that a higher disability percentage is merited. The
decisions made by the board can have serious long term
consequences on your medical and financial condition
and you should ensure your
rights are protected.
